DCL #5720: Clarification of news article: "Guevara-Omico break-up..."

This is in reference to the e-mail dated today, September 10, 2007, seeking confirmation/denial of the veracity of the Cocktails column entitled "Guevara-Omico breakup looms" published in the September 10, 2007 issue of the Manila Standard Today regarding the Joint Venture for the development of a mixed-use high-rise condominium complex between Guevara Group and Omico. The column stated in part that: "The joint venture agreement entered into by Omico Corp., Honeycomb Builders, Inc. and Guevent Industrial Development Corp. appears to be headed for a breakup unless Omico complies with an agreement to develop a prime real estate property at the corner of Edsa and Pasong Tamo Extension. Omico, a publicly listed corporation…has not started development on the 2,426 square-meter property contributed by the Guevara family's Honeycomb Builders and Guevent for the venture. xxx" Please be advised that while Omico has in the past received demand and follow-up letters from the Guevara Group, there have been several ensuing meetings between the representatives of the Guevara Group and the Management of Omico regarding the implementation of the Joint Venture Project in Makati. In fact, on the September 06, 2007 Board Meeting, Omico has created a committee to address all remaining issues and details on the Joint Venture Project with the Guevara Group and is looking forward to the commencement of the joint venture project at the soonest possible time.

Quoting paragraph 3 Mining Exploration Segment of Omico Stock Rights Prospectus page 8 of 73:
“The company is currently finalizing requirements for updating the statutory requirements of its MPSA application over the project area, which was filed on April 3, 1992. On June 19, 2007, the Company’s MPSA application together with the additional supporting documents, was endorsed and forwarded by the Department of Environment and Natural Resources-Cordillera Administrative Region (DENR-CAR) Office to the DENR Central Office.”
